Auction and sales terms
These terms apply to every bid, offer and purchase made on this website.
1. The seller
Works are sold directly by the artist, Maryam Naushad ("the studio"). No auction house or marketplace is involved.
2. Registration
To bid, buy or make an offer you must register with accurate contact details and be at least 18 years old. You are responsible for activity on your account. The studio may decline or cancel registrations at its discretion.
3. Bidding
Each bid is a binding offer to purchase the work at the resulting price. Maximum bids are executed automatically in the published increments. Bids cannot be withdrawn, except where the studio agrees in writing in cases of clear error reported before the auction closes.
4. Closing, extensions and reserves
A lot closes at the published time, extended by 5 minutes after any bid placed within the final 5 minutes. If a reserve applies and is not met, no sale takes place. The highest bidder at close, with any reserve met, is the buyer.
5. Price
The price is the hammer price or the fixed price shown. There is no buyer's premium. Delivery, insurance in transit, and any import duties or taxes in the destination country are additional and payable by the buyer.
6. Payment
Payment is due within 5 days of winning, or 48 hours of a fixed-price reservation, by the methods listed in your account. If payment is not received, the studio may cancel the sale, offer the work to another bidder and decline future bids from the buyer.
7. Delivery and risk
Works are released after payment clears. Risk passes to the buyer on collection or on delivery to the carrier for insured shipments; the studio will assist with any transit claim.
8. Condition and description
Works are original, hand-painted, and described in good faith. Dimensions are approximate to within 1 cm. Colours on screen may differ slightly from the painting.
9. Returns
Auction purchases are final. Fixed-price purchases may be returned within 7 days of receipt in original condition; return shipping is at the buyer's cost. Commissions are not returnable.
10. Copyright
Ownership of a painting does not transfer copyright. Reproduction, except for private, non-commercial display, requires the artist's written consent.
11. Law
These terms are governed by the laws of Pakistan. Disputes will first be addressed by discussion in good faith.
